Former Alabama basketball player Darius Miles indicted on capital murder charge

My heart goes out to the young mother who was killed. But I also have sympathy and prayers for Darius Miles. Just such stupid decision made by him and Davis. I always felt like the best way to defend myself is to try and remove myself from the situation first. It appears they did not do that. Now it could end up being self defense if it does turn out her boyfriend opened fire first. The trial should bring out the whole story.

Stabler Country, it could easily be a case of self-defense, and it doesn't take the boyfriend to fire the first shot. If the boyfriend introduced a weapon, and if you listen to the audio tape you can hear a shot a couple of seconds before you hear the 12 shots and before Davis grabs the weapon, which would account for the missing casing. Self-Defense would not stop an indictment, as the question of Self-Defense is for a jury to decide. If this was not a high profile case, I do not know if the DA would have indicted this case as a Capital Murder case, and if the case had not been indicted as a Capital Murder case, Miles would not be charged right now.

In Alabama, there is a duty to retreat, as long as retreat can be done safely. From what I have heard, I don't know if that was an option in this case. I will be very curious to see exactly what the video and ballistics show. I am sorry for the five year old child, I am sorry that a woman is dead, I am sorry that two young men are in jail charged with Capital Murder, but I am not ready to condemn the actions of anyone, until the facts come out.
