Parents of shooting victim call Brandon Miller's continued play for Alabama 'unimaginable'

l probably shouldn't make this post, but l will. l am very sorry the young lady was killed, but with a 5 year old child at home in B'ham l don't understand her being on the Strip, in Tuscaloosa at 2am in the morning, drinking and with Johnson who had drugs and a loaded gun in his car. She did not deserve to die of course, but l think Johnson had much more to do with her death than Miles did. Probably as much as Davis did. According to investigators Miller had nothing to do with it.

You said something we all were thinking.
 
The fact is that even if someone still believes that Miller should be suspended, even for PR token reasons, it would be a waste of time now. No matter what Oats and the administration did now would not be enough. If they threw him off the team, forfeited the BB season, suspended our BB program for next season too, it wouldn’t make a hill of beans difference, because, the joke journalists would still say “we waited too long”, or “it still isn’t enough”, or “see Oats and the administration knew he was guilty and tried to cover it up”, etc. Nothing would ever appease them, so why even try. By next season, if not much sooner, they will move on to their next victim. The only reason we are getting this much press is because our team is actually really good this year, and it involves a star player. If it was one of our normal years in the past couple decades, and a non superstar, this would have not been a story for even a week.

Agree. Don’t ask why Miller was out if you’re not willing to hear the question about why she was out.

When I was doing criminal cases, when an alleged suspect had a weapon, drugs, loaded cartridges in his car they called it the tools of the trade of a drug dealer. Early on I asked why she was 60 miles from home at 2:00 in the morning on the strip.

The penalty for being out with a drug dealer, if he was a drug dealer, is not death. I think Johnson is equally guilty in this case. The more I hear of the case, if you can reconcile all the versions, she was not clean. I just don’t know you can reconcile all versions and the video will tell a lot of the story.

I agree. That video would tell us a lot, though, I assume the authorities have seen it, so that is why they are keeping Miles friend. Again, I really appreciate your experienced knowledge on this affair, so I admit I am just guessing.

The guy who pulled the trigger and the guy who actually handed him the gun are in jail and being charged with capital murder.
 
All this sounds like to me is they are getting ready to sue someone. If her boyfriend fired the first shots...

I thought the same thing when I saw the comments but wasn't ready to call it out as such.
It doesn't matter if the boyfriend fired the first shots or not, if the boyfriend placed Davis in legitimate fear for his life and Davis fired the first shots after being placed in fear of his life, then there is a valid self defense plea as to the boyfriend. If she knew of the plan to ambush Miles and Davis, if that was the plan, then the self defense applies to her, especially if she handed Johnson the gun and cartridges, as might have been alleged.

In Alabama, the standard in a Wrongful Death Action is Wilful and Wanton Negligence on the part of the Defendant. The family can gear up all they want, but from all accounts it would be hard to plead that Miller was wilful and wantonly negligent in this incident, just as it would be hard to prove that he was criminally responsible. It would also be hard to hold the University liable for an event that happened off campus, at a place the University does not control. Other than Miles and Davis, I don't know who they could sue.

Remember the Limitations of Action Statute on Murder in Alabama is forever. I am willing to place a bet that Johnson, if he obtains counsel, will never show up and testify, before his attorney has a full viewing of the video evidence. If I was an attorney representing Johnson, the man would never testify and if he did he would assert the Fifth, unless I saw the Miles Video. If the dashcam was similar to Ring, I know that Miller's Attorney has already seen the video, so I would believe the attorney's statement, five weeks after the shooting, conforms to the video, the timeline and the events. I am as confident in a narration as an attorney can get on Miller's attorneys account of the events.

Agree. I said something similar already. She had to know Johnson was trouble. If I’m her parents, I’m blaming Johnson for having a gun, drugs, having her out at 2am, and having my daughter at a place she had no business, in a very hostile and dangerous situation. Honestly, she knew he was up to no good and should have removed herself from the situation.

Regardless of who fired the first shots...both parties had firearms and he knew this was not going to end well. He had ample opportunity himself to just never show back up at the scene of the final confrontation.

In my opinion he had an equal part in the young woman's death.

I wonder why there is no information on Johnson in any statement from police. I take it he was not arrested, but had drugs and a firearm. Something is weird about that to me.

Please don't sound intelligent. I've wondered the same. It is clear that they were not smoking Joints while they waited on Miles and Davis, as their shot was good and pot smokers are usually more docile. I would love to see the Blood Tox results in this case.
