In an extremely rare move, the Tuscaloosa DA has asked for a continuance in the Darius Miles case and the Preliminary Hearing has been rescheduled to February 21 at 9:00. At the present time there have been about 23 subpoenas issued. What all this means is anyones guess. I find it extremely odd that this many subpoenas would be issued for a preliminary hearing, as the sole issue is there enough evidence to hold the Defendant and bind his case over to the Grand Jury. A lot of times the State will call the Detective that will testify to his observations and facts and then the Judge will just send the case to the Grand Jury.

By looking at the subpoena list I think there will be plenty of video of the incident and the video will be strong evidence one way or the other. If I was the Judge I would want to see the video of the incident, if the video exist. I also enjoyed my research into the witness list, but as I suspected there are no good people in this incident, outside of law enforcement. The witness list tells me that if I still had a college age child and I found out that they were on the Strip late at night, they would probably be permanently headed home the next day. Tells me that the Strip is no place for a person to be after midnight.

Depending on the Judge this Prelim might take a while. A two hour Prelim is extremely rare.
